OPSoft Inc ("OPSoft", "we", "us", or "our") respects your privacy. This Privacy Policy describes how we collect, use, and share personal information when you visit our website at opsoftinc.com, contact us, or engage us for software engineering and cloud services.

We act as a data controller for information collected through this website and our direct business communications. When we process client end-user data under a customer engagement, we typically act as a data processor; that processing is governed by the relevant Master Service Agreement and our Data Processing Agreement.

Information we collect

Information you provide

  • Contact and project inquiries. When you fill in our contact form or email us directly, we receive your name, work email, company, and the contents of your message.
  • Business communications. Any information you share with us during scoping calls, proposals, contracts, invoices, and ongoing project work — including names and emails of points of contact at your organization.
  • Recruitment. If you apply for a role, the contents of your CV, portfolio, and any materials you send.

Information collected automatically

  • Server logs. Our hosting provider records standard request logs containing IP address, user-agent string, referrer, timestamp, and requested URL. These are used for security, abuse prevention, and operational diagnostics.
  • Technical data. Browser type, device type, operating system, and approximate location (derived from IP address) may be inferred from the same logs.

Information from third parties

  • Form processor. Our contact form is processed by Formspree. They temporarily handle submission data on our behalf before delivering it to us.
  • Fonts and maps. The website loads typefaces from Google Fonts and an embedded map from Google Maps. These services may receive your IP address and basic request headers as part of their standard delivery.

We do not deploy advertising trackers, third-party analytics pixels, or behavioral profiling cookies on this website.

How we use information

We use personal information to:

  • Respond to your inquiry and continue the conversation that you started.
  • Prepare proposals, statements of work, and contracts.
  • Deliver our services, including engineering, deployment, and ongoing support.
  • Invoice and collect payments and maintain financial records.
  • Operate, secure, and improve our website and internal systems.
  • Comply with legal, tax, and accounting obligations.
  • Defend our legal rights and investigate suspected abuse or fraud.

Legal bases for processing (GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, we process personal information under the following lawful bases:

  • Performance of a contract — to deliver the services you have engaged us for, or to take pre-contractual steps at your request.
  • Legitimate interests — to operate our business, secure our systems, manage client relationships, and pursue limited business development. We balance these interests against your rights.
  • Legal obligation — to comply with applicable laws, including tax and corporate-record requirements.
  • Consent — where required by law (for example, certain marketing communications). You may withdraw consent at any time.

How we share information

We do not sell personal information. We share it only with:

  • Service providers. Vendors who help us run the business under contract and confidentiality obligations: hosting, email, form processing, productivity, accounting, invoicing, and identity providers.
  • Clients and their authorized personnel, when shared communications are part of an active engagement.
  • Professional advisers such as lawyers, auditors, and insurers, bound by professional confidentiality.
  • Authorities, where we are legally required to disclose information — for example, in response to a valid subpoena, court order, or regulatory request. We push back on overbroad requests.
  • Successor entities, in connection with a merger, acquisition, or sale of assets, under appropriate confidentiality terms.

International data transfers

OPSoft Inc is established in the United States, and our service providers may operate in the United States, the European Union, the United Kingdom, and other jurisdictions. When personal data is transferred from the EEA, UK, or Switzerland to the United States or other countries that have not received an adequacy decision, we rely on appropriate safeguards such as the Standard Contractual Clauses (SCCs) and supplementary measures where required.

Data retention

We retain personal information for as long as is necessary to fulfil the purposes for which it was collected and to comply with our legal obligations. In general:

  • Unsuccessful prospect inquiries are kept for up to 24 months, then deleted or anonymized.
  • Client engagement records are kept for the duration of the relationship plus seven years (consistent with applicable tax and corporate-record retention).
  • Server logs are kept for up to 90 days, except where retained longer to investigate a specific incident.
  • Recruitment materials are kept for up to 12 months unless you ask us to keep them on file for future opportunities.

Security

We apply technical and organizational measures appropriate to the risk, including transport encryption (TLS), encryption at rest for sensitive systems, access controls based on least privilege, multi-factor authentication for administrative accounts, secret management with dedicated tooling, vendor due diligence, and security training for our team. No system is perfectly secure; we promise to be honest with you if something goes wrong.

Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Request deletion of your information, subject to certain legal exceptions.
  • Restrict or object to certain processing activities.
  • Receive your information in a portable format.
  • Withdraw consent where processing is based on consent.
  • Lodge a complaint with a supervisory authority (for EEA/UK residents) or your state's Attorney General (for U.S. residents, where applicable).

Cookies and similar technologies

This website does not set any first-party cookies for analytics or advertising. The embedded Google Maps element and Google Fonts service may set cookies under their own policies when loaded; you can block these by using your browser's third-party content settings.

Children's privacy

Our services are intended for businesses and the professionals working for them. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us so we can delete it.
